How to submit an application
If you have collected all necessary documents and documentary evidence, you can submit an application for a residence permit.
In order to enter the Netherlands for a stay of more than 3 months, your employee will, in many cases, require a special visa. This is called a regular provisional residence permit (mvv). The procedure will then be slightly different as to when no mvv is required.
Your employee does not require an mvv if he originates from one of the following countries:
•An EU Member State
•Australia
•Canada
•Japan
•Monaco
•New Zealand
•Vatican City
•United States of America
•South Korea
Residence permit without a regular provisional residence permit (mvv)
Does your employee not require an mvv? In that case, you submit an application for a single permit at the IND. You can best do this if your employee is still residing abroad. As soon as the IND has given notice that a single permit will be issued, your employee may come to the Netherlands. You will then have certainty that he can travel to the Netherlands. You can also submit an application while your employee is already staying in the Netherlands. In that case, however, you will not know for sure whether your employee will be granted a single permit. Moreover, it may be difficult to get all documents required to the Netherlands.
Once the application is granted, you will be notified by the IND as to when the employee can collect his single permit. The single permit consists of a residence document and an additional document. The single permit is issued to the employee in person. From that moment, the employee is permitted to work in the Netherlands as specified in the additional document.
You will receive a copy of the additional document after the single permit has been issued to the employee. You must keep this copy pursuant to the duty to keep records.
N.B. In order to be able to employ a Japanese national, you must not submit an application for a single permit, but an application for a residence permit 'to gain work experience'. A work permit is not needed for Japanese nationals.
Entry and residence
Does your employee require an mvv? In that case, you submit a combined application for an mvv and a single permit. This is the procedure for 'Entry and Residence' (TEV). If the IND grants an mvv, you will inform your employee of this. The employee must collect the mvv at the Dutch embassy or the Dutch consulate within 3 months. After that, he will have 3 months to enter the Netherlands.
Once the application is granted, you will be notified by the IND as to when the employee can collect his single permit. The single permit consists of a residence document and an additional document. The single permit is issued to the employee in person. From that moment , the employee is permitted to work in the Netherlands as specified in the additional document.
You will receive a copy of the additional document after the single permit has been issued to the employee. You must keep this copy pursuant to the duty to keep records.
Start the procedure
There are 2 ways to start the procedure: with an application form customised to your situation (only available in Dutch) via the Klantdienstwijzer or by submitting a standard application form (only available in Dutch).
Customised application form
Via the Klantdienstwijzer you will be led to the form required for your employee. Please choose 'Wat moet ik doen als' > 'Ik wil iemand naar Nederland halen' (What do I have to do > to bring someone to the Netherlands) and answer the
questions asked. You will then see which purpose is applicable and can start the procedure by filling in the application set at the end of the questionnaire.
Standard application form
Via the IND website you first go to 'Business' and subsequently select 'Employer'. Under 'Forms and brochures' you will then find various standard application forms. You can then print the required form and fill it in.
