Partijen zien met elkaar gehuwd gew

Partijen zien met elkaar gehuwd geweest en besloten in 2011 om door onderlinge toestemming uit de echt te scheiden.

Daarvoor deden zij beroep op notaris WALLAYS te Leuven.

Op 31 mei 2012 werd voor notaris WALLAYS de regelingsakte verleden.

In deze akte wordt vermeld:

De akte vermeldt letterlijk dat er door geen van beide partijen een opleg dient te worden betaald.

Partijen waren immers een opleg van 20500 E overeengekomen die concluant voorrafgaand aan het verlijeden van de akte reeds ann mevrow Fukunishi had betaald, zodat deze niet meer vermeld diende te worden in de akte zelf.

Thans beweert mevrouw Fukunishi tegen de stukken van het dossie in dat er een opleg van 80,000 E in haar voordeel zou zijn overeengekomen en dat concluant haar bijgevolg nog een saldo van 59m500 E verschuldigd zou zijn.

Het is voor dit beweerde saldo van 59,500 E dat mevrouw Fukunishi overging tot dagvaarding van concluant.
